Patent Application

Utility Model Registration in Türkiye

A utility model protects a new and industrially applicable technical solution in Türkiye for up to ten years, through a simpler and usually faster procedure than a patent. It suits product improvements, mechanical solutions and devices with a short commercial life. We assess whether a utility model or a patent fits your invention, draft the application and follow it to registration.

How it works

  1. Assessment

We review the invention and tell you whether a utility model or a patent is the better fit.

  2. Drafting

We draft the description, claims and abstract and prepare the drawings with you.

  3. Filing and search

We file at TÜRKPATENT, which issues a search report; third parties can submit observations.

  4. Registration

We answer the Office and any observations, and you receive the utility model certificate.

Utility model or patent?

Both protect technical inventions. A patent requires novelty, inventive step and industrial application and lasts up to 20 years after a substantive examination. A utility model requires novelty and industrial application, is registered without an examination of inventive step and lasts up to 10 years. For a product improvement with a short market life, a utility model often gives sufficient protection sooner.

What cannot be a utility model

Processes and products obtained by processes, chemical and biological substances and pharmaceutical products are excluded from utility model protection; they can be protected by a patent instead. The general exclusions that apply to patents, such as discoveries, scientific theories and methods of doing business, apply here too.

Converting between the two

While it is pending, a patent application can be converted into a utility model application within the time limits of the law, for example when the search shows that inventive step will be hard to prove. We plan the route at the start, so the choice can still be adjusted.

Legal basis

Frequently asked questions

How long does a utility model last in Türkiye?

Up to 10 years from the filing date. It cannot be extended beyond that, and the annual fees must be paid to keep it in force.

Is a utility model easier to obtain than a patent?

It does not require inventive step and is registered without substantive examination, so the procedure is usually simpler and faster. The protection is shorter and some subject matter, such as processes and chemical substances, is excluded.

Can a foreign company file a utility model in Türkiye?

Yes, through a registered Turkish patent attorney. Priority from an earlier foreign application can be claimed within 12 months.
