Why search before filing

TÜRKPATENT examines every application for absolute grounds, such as descriptive, generic or misleading signs, and refuses on its own initiative a sign that is identical or indistinguishably similar to an earlier registered or applied-for mark covering identical or same-type goods and services (SMK article 5(1)(ç)). Every other conflict is left to the owners of earlier marks, who can oppose within two months of publication in the Official Trademark Bulletin. A search tells you both risks before you invest in the application, the packaging and the launch.

What we look at

• Identical and similar word marks, including different spellings, translations and transliterations
• Figurative elements of logos and their dominant parts
• The Nice classes and the actual goods and services, since similarity of goods matters as much as similarity of signs
• Well-known and reputed marks, which are protected beyond their own goods and services
• Trade names and domain names, where they show earlier use in Türkiye

How to read the result

Our written opinion ranks each earlier mark by risk and explains why. Where the risk is limited to some goods or services, we usually suggest narrowing the specification rather than giving up the mark. Where a blocking mark appears unused for five years, we explain the non-use revocation route before you decide.

Searching for a launch abroad

If the brand will also be used outside Türkiye, the search can be extended to the countries you plan to enter through our partner attorneys, so the same name can be cleared in one project.
