Appeals Against TÜRKPATENT Decisions (YİDK)
If TÜRKPATENT refuses your application in whole or in part, or decides an opposition against you, you can appeal to its Re-examination and Evaluation Board (YİDK) within two months of the decision's notification. We review the decision, build the arguments and evidence and file the appeal.
At a glance
- Who it is for
- Applicants facing a refusal, and parties who lost an opposition decision.
- What we do
- A reasoned appeal to the YİDK, with evidence and, where useful, a limited specification.
- What you send us
- The decision, the file history and any evidence of use or distinctiveness.
- Timeline
- Two months from notification of the decision to file the appeal.
How it works
Decision review
We read the reasons for refusal and check which goods and services are affected.
Strategy
We decide whether to argue, limit the specification, add evidence of acquired distinctiveness or seek a consent.
Appeal filing
We file the reasoned appeal with the YİDK within the two-month period.
Board decision
The Board's decision is final at the Office; it can be challenged before the Ankara Intellectual and Industrial Property Rights Civil Court within two months of notification, where clients are represented by lawyers.
Typical grounds for refusal
- Descriptive or non-distinctive signs (SMK article 5)
- Identity or indistinguishable similarity with an earlier mark for identical or same-type goods and services (SMK article 5(1)(ç))
- An upheld opposition based on likelihood of confusion or reputation (article 6)
What makes an appeal stronger
A focused argument on the overall impression of the signs, the actual differences between the goods and services, evidence that the mark has acquired distinctiveness through use, and, where appropriate, limiting the list of goods to remove the conflict.
Who can appeal
Any party to the proceedings whose rights are affected by the decision: the applicant after a refusal, the opponent after a rejected opposition and the applicant after an upheld one.
After the Board
The Board's decision is the Office's final word. It can be challenged before the Ankara Intellectual and Industrial Property Rights Civil Court within two months of its notification; court proceedings are conducted by lawyers.
Legal basis
Industrial Property Law No. 6769 (SMK), article 20 (appeals to the Re-examination and Evaluation Board).
Documents checklist

Frequently asked questions
How long do I have to appeal?
Two months from the notification of the decision. Missing the deadline makes the decision final at the Office.
Can I limit my application instead of appealing?
Limiting the goods and services can be part of the appeal strategy and often resolves a partial refusal.
What happens after the YİDK?
The Board's decision can be challenged in court within two months of its notification; court proceedings are conducted by lawyers, and we coordinate the file with them.
