Trademark Application in Turkey
Trademark Assignment, Licence and Change Recordals
When a Turkish trademark is sold, licensed, merged into another company or its owner changes name or address, the change should be recorded at TÜRKPATENT. Recording makes the transaction effective against third parties and keeps the register, renewals and enforcement in the right name. We prepare the documents and file the recordals.

How it works
Review
We review the agreement or the corporate change and the marks involved.
Documents
We prepare or check the deed of assignment, the licence or the certificate, with translations where needed.
Filing
We file the recordal request and pay the official fee.
Updated register
TÜRKPATENT records the change; we confirm the new entry.
Why record
Rights arising from a transaction that is not recorded in the register cannot be asserted against third parties acting in good faith (Industrial Property Law No. 6769). An unrecorded owner may also face problems in oppositions, renewals and enforcement.
Form
Assignments and licence agreements of registered rights must be made in writing. TÜRKPATENT checks the signatures and the description of the marks, so we review the document before signature where we can.
Licences
Exclusive and non-exclusive licences can be recorded. We also draft and review licence agreements: scope, territory, quality control and term.
Legal basis
Industrial Property Law No. 6769 (SMK), article 148 (transfer and licence, and their effect against third parties).
Documents checklist
- Assignment agreement, licence agreement or certificate of merger, name or address change
- Translations of foreign documents
- A power of attorney
Frequently asked questions
Is recording a licence mandatory?
A licence is valid between the parties without recordal, but recording it makes it effective against third parties.
Can foreign documents be used?
Yes, with a Turkish translation; we tell you exactly which formalities apply to your document.
