Patent Application
Patent Search and Freedom to Operate in Türkiye
Before filing a patent, a patentability search shows how new your invention is compared with what is already published. Before launching a product, a freedom-to-operate (FTO) review shows whether patents in force in Türkiye could block it. We run both searches in patent databases and give you a written opinion you can act on.
At a glance
- Who it is for
- Inventors and R&D teams before filing, and companies before launching or importing a product into Türkiye.
- What we do
- Patentability searches, freedom-to-operate reviews, state-of-the-art and competitor patent searches, with a written opinion.
- What you send us
- A description of the invention or product, its key technical features and the countries concerned.
- Timeline
- Agreed per search depending on the field and depth, and stated in our written quote.
How it works
Scope
We define the technical features, the countries and the question the search must answer.
Search
We search patent and literature databases by keywords and patent classifications.
Analysis
We read the closest documents and compare their claims or disclosures with your invention or product.
Written opinion
You receive the results, the risks and our recommendation: file, redesign, license or challenge.
Patentability search
A patent is granted only for an invention that is new, involves an inventive step and is industrially applicable. A search before filing shows the closest prior art, helps you draft claims that avoid it and can save the cost of an application that would fail.
Freedom to operate
An FTO review looks at the claims of patents and published applications that are in force or could be granted in Türkiye and asks whether your product falls within them. Owning a patent does not give freedom to operate: your product can still infringe someone else's earlier patent.
What the opinion covers
- The relevant documents and their legal status in Türkiye
- A claim-by-claim comparison for the closest patents
- Options where there is a risk: design-around, licence, waiting for expiry, or an invalidity challenge
Where patents come from
Patents in force in Türkiye are national patents granted by TÜRKPATENT and European patents validated in Türkiye. Both are covered by our searches.
Documents checklist
- A description of the invention or product, with drawings or photos
- The key technical features
- Known competitors or prior documents, if any
- The countries where you will file, make or sell
Frequently asked questions
What is the difference between a patentability search and an FTO?
A patentability search asks whether your invention is new and inventive compared with everything published. An FTO asks whether your product would infringe patents in force in a given country.
Do European patents count in Türkiye?
Yes. Türkiye is a member of the European Patent Convention, and a European patent validated in Türkiye has the same effect as a Turkish patent.
Can a search guarantee that my product is free to use?
No search can rule out every risk, for example applications not yet published. A well-scoped search reduces the risk to a level on which you can make an informed decision.
