Trademark Application in Turkey

Customs Recordal and Anti-Counterfeiting in Türkiye

Registered trademark owners can ask Turkish Customs to watch for goods that infringe their rights. When a suspicious shipment is detected, customs suspends its clearance and notifies the right holder, who must then act within a short legal deadline. We file the customs application and coordinate the response when goods are stopped.

At a glance

Who it is for
Owners of trademarks, designs and other registered rights facing imitations or parallel imports.
What we do
The customs protection application, product identification guidance and coordination when goods are detained.
What you send us
Your Turkish registrations, product details and information that helps officers recognise genuine goods.
Timeline
After notification, the right holder has 10 working days to start court action or obtain an injunction (extendable once by 10 working days in justified cases; 3 working days for perishable goods).

How it works

  1. Application

We file the application through the Ministry of Trade's electronic system with your registrations.

  2. Identification

We prepare information that helps customs officers distinguish genuine from infringing goods.

  3. Detention

When a shipment is suspended, we inform you at once and examine the goods' samples or photos.

  4. Follow-up

We coordinate with lawyers who start the court action or seek an injunction within the legal deadline.

Legal basis

Article 57 of Customs Law No. 4458 allows customs to suspend the release of goods suspected of infringing trademarks, designs, geographical indications and copyright, on the right holder's application or ex officio. If the right holder does not start court action or obtain an interim measure within 10 working days of notification (extendable once by 10 working days in justified cases; 3 working days for perishable goods), the goods are released.

Our role

We handle the application and the communication with customs and coordinate the court steps, which are conducted by lawyers.

What makes a customs application work

Clear, practical information for the officers: photos of genuine products and packaging, the differences that reveal fakes, the authorised manufacturers and importers, and the usual routes and ports. We update the file when your products or distributors change.

Documents checklist

  • Turkish registration certificates
  • Product photos and descriptions of genuine goods
  • Information on authorised manufacturers, importers and routes
  • A power of attorney

Frequently asked questions

Does customs act without an application?

Customs can act ex officio when there is clear evidence, but an application on file makes detection far more likely.

What happens after goods are detained?

The right holder must start court action or obtain an injunction within 10 working days of notification (extendable once by 10 working days in justified cases; 3 working days for perishable goods), otherwise the goods are released.
